Say who you represent, then put it in writing

At a Utah open house you are usually there for the seller, and many of the people walking through are not represented by anyone. Utah's affirmative-duty rule for licensees requires you to disclose your agency relationships in writing before a binding purchase agreement is executed. Treat that as the outside deadline rather than the target. Say plainly at the door that you work for the seller, and have the written agency disclosure signed well before anyone starts drafting an offer.

Stop calling the moment someone tells you to

Utah's Telephone and Facsimile Solicitation Act carries an exemption at Section 13-25a-111: its solicitation-conduct section (13-25a-103) and its do-not-call section (13-25a-108) do not apply to a person who holds and acts within the scope of a license issued by the Division of Real Estate. So the 9 p.m. to 8 a.m., Sunday and legal-holiday calling windows in 13-25a-103, and the do-not-call registry rule in 13-25a-108, are not what governs your open house follow-up. Section 13-25a-107.2 is not on that exemption list, and it binds you: once a visitor tells you, in writing or out loud, that they do not want your calls, you stop. Log that request against the lead the day it happens, and remember federal telemarketing law still applies on top of all of this.

A telephone solicitor may not make or cause to be made a telephone solicitation to a person who has informed the telephone solicitor, either in writing or orally, that the person does not wish to receive a telephone call from the telephone solicitor.

A written buyer agreement, once you represent them

Utah required written buyer agency agreements long before the NAR settlement, and the Division of Real Estate published that clarification in 2024 to settle the confusion. The trigger in the rule is representation: if you represent a buyer, you must execute a written buyer agency agreement with them. The Division adds that at a minimum the agreement must be executed before drafting the purchase agreement, and encourages getting it earlier. So the moment an open house visitor stops being a walk-in and starts being someone you are acting for, get the agreement signed rather than waiting for offer night.

Guard the list, and destroy what you do not keep

Utah's Protection of Personal Information Act puts two duties on any business holding personal information: keep reasonable procedures that prevent unlawful use or disclosure of it, and destroy records you are not keeping, by shredding, erasing, or otherwise making the data indecipherable. Read the chapter's own definition before assuming it misses you. Section 13-44-102 defines personal information as a name combined with a Social Security number, a financial account or card number, or a driver license or state identification card number, so a plain name, phone and email list sits outside the statute while anything more sensitive pulls you straight into it. Either way the practical answer is the same: keep the sign-in list in your account instead of on a shared clipboard or an unlocked screen at the door, and get rid of what you no longer need.

Any person who conducts business in the state and maintains personal information shall implement and maintain reasonable procedures to: (a) prevent unlawful use or disclosure of personal information collected or maintained in the regular course of business; and (b) destroy, or arrange for the destruction of, records containing personal information that are not to be retained by the person.
